Public Right of Way

The City Of Hudson’s Land Development Code identifies the right-of-way as a strip of land dedicated to and/or improved for vehicular and/or pedestrian travel by the public.

A right-of-way permit must be obtained prior to the construction, reconstruction, alteration, repair, removal or replacement of any culvert, sidewalk, apron or driveway on any public street or road right-of-way. A right-of-way permit is also required prior to the repair, replacement, installation or construction of utility services and sanitary/storm sewers.

Right of Way Application
An application for a permit to work within the right-of-way, detailed plan, fee and deposit must be submitted to the Community Development Department for review.


Ditch Elimination Application/Submittal Packet

A homeowner may wish to install a ditch elimination pipe in the right-of-way abutting his property. The homeowner must submit an application for a permit to work within the right-of-way, detailed plan, fee, deposit and notarized affidavit to the Community Development Department for review.


Contractor Bond Form
A properly executed Contractor Bond Form may be submitted by a contractor in lieu of the required $1500 right-of-way deposit. The Bond will apply to permits issued to same contractor for the current calendar year.
